1. OVERVIEW

This website is operated by Madeleine S Jewellery. Throughout the site, the terms “we”, “us”, and “our” refer to Madeleine S Jewellery.

By accessing our website or purchasing from us, you agree to these Terms of Service (“Terms”). If you do not agree, you should not use our website or services.

2. GENERAL CONDITIONS

We reserve the right to refuse service at our discretion.

All content, designs, and materials on this website are provided for personal use only and may not be reproduced or used without prior written consent.

3. OUR PIECES

Each piece is made to order unless stated otherwise.

Due to the handcrafted nature of our jewellery, slight variations in finish, stone characteristics, and dimensions may occur. These variations are a natural part of the making process and contribute to the uniqueness of each piece.

Product imagery is provided as a guide and may not represent the final piece exactly.

4. PRICING & PAYMENT

All prices are listed in AUD and may be updated at any time.

Payment, whether full or partial, is required before production begins. We reserve the right to correct any errors in pricing or product information.

5. CUSTOM ORDERS

Each piece is created to your specifications.

Production will begin once:

Your design has been finalised
Stone selection has been confirmed
Payment or deposit has been received

At this stage, your order is secured in our production schedule.

6. CANCELLATIONS

Within 24 hours (prior to production):

Orders may be cancelled for a full refund.
Once production has commenced:

Orders cannot be cancelled or refunded. This includes once materials are sourced or crafting has begun.

7. DEPOSITS

Where a deposit is taken, it becomes non-refundable once production has commenced, as it covers design, sourcing, and materials.

8. ORDER CHANGES

Adjustments may be accommodated prior to production.

Once production has begun, changes may not be possible. Where they can be made, additional costs and revised timelines may apply.

9. RETURNS & EXCHANGES

Each piece is made to order. As such, custom jewellery is final sale and not eligible for return or exchange.

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.

If a piece is found to have a major fault, is not as described, or is not of acceptable quality, you may be entitled to a repair, replacement, or refund in accordance with applicable law.

10. PRODUCTION & DELIVERY

Production timelines are provided as a guide and may vary depending on the design and material availability.

We are not responsible for delays caused by third parties or circumstances beyond our control.

Responsibility for the piece passes to you upon dispatch.

11. SIZING

Accurate sizing is essential.

Customers are responsible for confirming correct measurements prior to ordering. Certain designs, including full eternity bands, cannot be resized.

Where resizing is possible, it may incur additional costs.

12. CARE

Fine jewellery should be worn and stored with care.

We are not responsible for damage resulting from everyday wear, accidental impact, or improper handling.

13. INTELLECTUAL PROPERTY

All designs, imagery, and content on this website remain the property of Madeleine S Jewellery.

Custom designs created by us remain our intellectual property unless otherwise agreed.

14. THIRD-PARTY SERVICES

We may engage trusted third parties for services such as payment processing and delivery.

We are not responsible for the policies or actions of these providers.

15. LIABILITY

To the extent permitted by law, we are not liable for any indirect or consequential loss arising from the use of our products or services.

16. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

17. WARRANTY

Each piece is crafted with care and precision.

We offer a 12-month manufacturing warranty from the date of delivery, covering faults in workmanship.

This warranty does not cover:

Normal wear over time
Surface scratches or signs of use
Damage from impact, misuse, or improper care
Loss of stones due to wear or external damage

If you believe your piece has a manufacturing fault, please contact us with proof of purchase and images. We will assess the piece and advise on the appropriate resolution.

This warranty is provided in addition to your rights under the Australian Consumer Law.

18. DIAMOND CERTIFICATION

We source our diamonds with care and intention.

All diamonds 1.0 carat and above are accompanied by independent certification from internationally recognised laboratories, including the Gemological Institute of America and the International Gemological Institute.

Each certificate verifies the diamond’s cut, colour, clarity, and carat weight.

Diamonds below 1.0 carat may not include certification unless otherwise specified.

19. CHANGES TO THESE TERMS

We may update these Terms from time to time.

Where required, notice of material changes will be provided. Continued use of our website following such updates indicates acceptance, to the extent permitted by law.
